Sweden says no to new EU divorce-policy

Today the ministers of justice of the EU met and aggreed on a deepened cooperation and a proposal for new divorce rules. The new proposal gives spouses of different nationalities living in different countries or who live together in another EU-country the possibility to choose which counry's divorce laws they intend to abide to.

Sweden says no to the proposal as much today as two years ago when it stopped the proposal. The Swedish resistance is about the issue that Swedish courts could be forced to base their judging on other countries' laws. This would mean a violation of the relatively liberal divorce law in Sweden. For example the person who wants a divorce might be forced to prove that the marriage is not working well.
